Terms & Conditions

These terms govern your use of 91 Kitchens at 91kitchens.com (the "Service"), operated by System 3 Net Technologies Pvt. Ltd., CIN U72900DL2001PTC112522, registered office 301, Siddharth Building, 96 Nehru Place, New Delhi 110019 ("we", "us"). By signing in or using the Service you agree to them. If you use the Service for a business, you confirm you are authorised to accept these terms for it.

The Service

91 Kitchens reads payout reports that food aggregators provide to food businesses, and produces analysis, charts, comparisons between months and suggested actions. It is available to restaurants, hotels, cloud kitchens, quick-service restaurants and similar food businesses.

The Service is informational. It is not accounting, tax, legal or financial advice. Figures are worked out from the files you upload; we do not verify them with any aggregator. Please check important decisions, claims and tax positions with your own advisers.

Accounts and access

• Access is by invitation, and sign-in is with a Google (Gmail) account. You are responsible for activity under your account.
• One free first report is available per business. Creating additional accounts, altering report files, or any other attempt to obtain further free reports is not permitted, and we may decline or withdraw access where we detect it.
• Invitations are personal and may be withdrawn if misused.

Your files and data

• You confirm that you have the right to upload the reports you upload, and that they relate to a business you own or are authorised to act for.
• You keep ownership of your data. You permit us to store and process it to provide the Service, as described in our Privacy Policy, including studying reports in combined form to improve the analysis. One business's figures are never shown to another.
• Do not upload files that are not aggregator payout reports, that contain malicious content, or that you are not permitted to share.

Plans, prices and payment

• The first report is free. Paid plans are billed in advance, annually (the yearly amount upfront) or monthly, as you choose, at the price shown on the Plans page at the time you subscribe, plus GST at 18%.
• Subscriptions renew automatically at the end of each billing period (a year or a month) through the mandate you authorise with our payment gateway (UPI Autopay or card), until cancelled.
• Tax invoices are issued by System 3 Net Technologies Pvt. Ltd. (GSTIN 07AAGCS8224D1ZG). To have your business GSTIN on your invoices, write to hello@91kitchens.com before the payment is made.
• We may change prices for future billing periods; we will tell you at least 15 days before a change applies to you, and you may cancel before it does.
• Features described as "coming soon" are not part of any plan until they are released.

Cancellation and refunds

You can cancel at any time from your account page; access continues until the end of the billing period you have paid for. Refunds are covered by our Refund & Cancellation Policy.

Acceptable use

You agree not to: misuse or attempt to break the Service or its security; access other people's data; scrape, copy or resell the Service or its reports as your own product; use it for anything unlawful; or impersonate anyone.

Our intellectual property

The Service, its software, design, analysis methods and content (excluding your data) belong to us or our licensors. You may use reports produced for you within your own business, including sharing them with your advisers and your aggregator.

Independence from aggregators

91 Kitchens is independent and is not affiliated with, endorsed by or acting for any food aggregator. Names of aggregators are used only to describe the reports the Service reads. Any request you send to an aggregator using our suggestions is your own.

Availability and changes

We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may improve, change or discontinue features. If we discontinue a paid plan, we will refund any unused prepaid period.

Liability

To the extent the law allows, the Service is provided "as is", and we are not liable for indirect or consequential losses, lost profits, or decisions made on the basis of the Service's output. Our total liability to you for any claim is limited to the fees you paid us in the three months before the claim arose.

Suspension and termination

We may suspend or close accounts that breach these terms. You may close your account at any time. On closure, your data is handled as set out in the Privacy Policy.

Governing law and disputes

These terms are governed by the laws of India. Courts at New Delhi have exclusive jurisdiction. Before going to court, please write to us so we can try to resolve the matter.
